Price and payments

1. It is required that in order to join the organization you register your payment approved by the organization, and it’s vendors.

2. The organisation uses IPP Europe ApS, as an approved acquirer for all transactions. All transactions are handled encrypted, no card data will therefore appear visible.

3. Your order confirmation will be sent to your email.

4. Upon purchase you accept the terms and conditions of the organization.

5. Canceling of your membership and related payments herein is made through contacting the organization by email.

Recurring payments and payment plans

1. With Recurring payments and payment plans, you will at your first payment accept that the organization can charge future payments from your payment card. You can always change or cancel your payments by reaching out to the organization.

2. The amount due for your payment will be automatically charged according to your payment plan and service ordered.

3. You can receive an SMS / email latest within 10 days of your due payment, stating the amount due.

4. With Recurring payments and payment plans from your payment card, your card information will not be stored with the organization, but will be stored through IPP Europe ApS

5. Before any expiration of your payment card, the organization will send a warning reminding you to update your payment information.

6. When you have received your new payment card you will log-in to the organizations system and update your information in due time

7. In case your card will be blocked by your bank, you are responsible for registering a new payment card, this also happens within the system of the organization

RUUTU10 TEENUSE KASUTUSTINGIMUSED


Käesolevad Kasutustingimused tulevad kohaldamisele Ruutu10 ja Kasutaja vahel. Definitsioonid


1.1. Kasutaja – Veebisaidi registreeritud või registreerimata kasutaja, st Pileti või kauba ostja.

1.2. Kasutustingimused – käesolevad Ruutu10 poolt kehtestatud üldtingimused Veebisaidi kasutamiseks, mis on esitatud Veebisaidil.

1.3. Müügileping – Ruutu10 ja Kasutaja vahel sõlmitud leping, mis annab Pileti esitajale õiguse Ürituse külastamiseks.

1.4. Pilet – vigastamata dokument originaalblanketil või elektrooniline pilet, mis tagab selle esitajale õiguse sissepääsuks Üritusele ja Ürituse mittetoimumisel nõuda Korraldajalt Pileti tagasiostu.

1.5. Ruutu10 – Ruutu10 OÜ, registrikood 12735051, mis vastutab kõigi Üritusega seotud asjaolude eest, sh Ürituse toimumise eest.

1.6. Veebisait – Internetikeskkond www.ruutu10.ee.

1.7. Üritus – Ruutu10 poolt üldsusele korraldatav meelelahutus-, avaliku elu, äri- või reklaamsündmus, sh esinemine, etendus, kontsert, töötuba, koolitus, disko, vms sündmus, mille külastamiseks tuleb lunastada pääse ehk Pilet.

Müügilepingute sõlmimine

3.1. Müügilepingu täitmise eest vastutab Ruutu10. Piletiga seotud õigused ja kohustused kehtestab Pileti ostjale Ruutu10, mis vastutab Pileti ostja ees nende õiguste ja kohustuste sisu, muutmise ja täitmise eest.

3.2. Müügileping Ruutu10 ja Kasutaja vahel loetakse sõlmituks Pileti hinna laekumisega Ruutu10 arvelduskontole. Krediitkaardiga tasumise korral toimub laekumine tavaliselt pärast 3 (kolme) tööpäeva möödumist makse tegemisest.

3.3. Kui Müügileping Korraldaja ja Kasutaja vahel on sõlmitud, edastab Ruutu10 Kasutajale ostetud elektroonilise Pileti e-posti teel.


Kasutaja kinnitused, õigused ja kohustused

4.1. Veebisaidil mistahes toimingu tegemisega kinnitab Kasutaja, et:

4.1.1. ta on vähemalt 18-aastane teovõimeline füüsiline isik (alla 18-aastane isik kinnitab, et tal on Veebisaidi kasutamiseks, sh Pileti ostmiseks, seadusliku esindaja vastav nõusolek ja viimaselt selleks otstarbeks või vabaks kasutamiseks saadud rahalised vahendid);

4.1.2. ta on juriidilise isiku esindaja, kellel on kõik õigused selle juriidilise isiku nimel Veebisaiti kasutada ja sellele juriidilisele isikule kohustusi võtta;

4.1.3. ta täidab nõuetekohaselt kõiki Kasutamistingimusi;

4.1.4. ta on teadlik, et Veebisaidi kasutamiseks vajaliku kasutajatunnuse ja salasõna sattumisel kolmandate isikute kätte vastutab Kasutaja selliste isikute poolt Kasutajale võetud kohustuste täitmise eest;

4.1.5. Tarbijast Kasutaja on teadlik, et tal puudub Müügilepingust taganemise õigus võlaõigusseaduse § 53 lg 4 p 7.2 kohaselt.

4.2. Kasutaja kohustub esitama Veebisaidi kasutajaks registreerimisel tõesed isikuandmed, sh registreeruma oma õige ja täieliku nime all ning kasutama kehtivat e-posti aadressi.

4.3. Kasutajal on õigus pärast Korraldajaga Müügilepingu sõlmimist nõuda Pileti väljastamist, võttes arvesse käesolevates Kasutustingimustes toodut.

4.4. Kasutaja kohustub hoiduma mistahes viisil ja vahenditega Veebisaidi toimimisse ja tehnilistesse lahendustesse sekkumisest. Igasugune tegevus, millega võib kaasneda Veebisaidi ülekoormamine või selle toimimise häired, on keelatud. Veebisaidi kasutamise monitooring (jälgimine, loendamine) ja saadud andmete kopeerimine, reprodutseerimine, kasutamine, muutmine ja avaldamine on mistahes eesmärkidel keelatud.


Ruutu10 õigused, kohustused ja vastutus

5.1. Ruutu10-l on õigus katkestada Müügilepingu sõlmimine ja/või eemaldada Kasutaja Veebisaidilt, kui Ruutu10 kahtlustab, et Kasutaja toimib ebaausalt või seadusevastaselt.

5.2. Ruutu10-l on õigus igal ajal piirata Kasutaja poolt ostetavate Piletite arvu ja katkestada lubatust suurema koguse Piletite ostutehingud. Ruutu10-l on õigus müüdavate Piletite arvu piirata mh Veebisaidi ostukorvi seadistustega.

5.3. Ruutu10 ei vastuta kolmandate osapoolte põhjustatud võimalike vigade eest, mis põhjustavad olukorra, kus rahaülekanne või kaardimakse võib ebaõnnestuda.

5.4. Ruutu10 poolt märgitud Piletite kättetoimetamise tähtajad on ligikaudsed ja Ruutu10 ei vastuta Pileti kättesaamise viibimise eest, mille on põhjustanud Kasutaja poolt sisestatud ebatäpsed andmed, juhised, kolmandate isikute tegevus ning muud Ruutu10-st sõltumatud asjaolud. Ruutu10-l on õigus Pileti kättetoimetamine katkestada, kui kättetoimetamise eest ei ole tasutud vastavalt hinnakirjale, Kasutaja on esitanud valed või ebatäpsed andmeid (nt vale e-posti aadress) või Kasutaja ei ole esitatud aadressilt kättesaadav.

5.5. Ruutu10 ei vastuta Pileti kolmandate isikute kätte sattumisega kaasnevate mistahes kahjude eest (sh juhul, kui Pilet satub kolmandate isikute kätte ebakorrektse e-posti aadressi sisestamise tõttu, sisestatud e-posti aadressile määratud automaatsete suunamiste vms tõttu). Ruutu10 ei vastuta hävinud, kaotatud, varastatud ega rikutud Piletite ega kauba eest.

5.6. Ruutu10 ei ole kohustatud Pileteid või kaupa tagasi ostma või hüvitama, kui ta seda teeb, siis ei tagastata ostu teenustasude maksumust. Ruutu10 hüvitab või ostab tagasi Piletid juhul, kui Ruutu10-st sõltuvatel põhjustel Üritus ei toimu, lükatakse edasi, muudetakse toimumise kohta või asendatakse muu Üritusega. Piletite tagasiostu ja/või hüvitamisega tegeleb Ruutu10, kui ei ole teatatud teisiti.

5.7. Ruutu10 kontrollib soodushinnaga Pileti ostmisel ostja hinnasoodustuse saamiseks vajalike tingimuste olemasolu Ürituse toimumise kohass.

5.8. Ruutu10 ei kontrolli Pileti esitaja ja Pileti ostnud isiku samasust ega vastuta sellest tingitud mistahes kahjude eest.


Intellektuaalne omand

6.1. Ruutu10-le kuuluvad kõik autoriõigused Veebisaidile ja selle koosseisus olevatele teostele, sealhulgas tarkvarale, tekstidele, andmebaasidele ja graafilisele kujundusele.

6.2. Kasutajal ja teistel isikutel ei ole ilma Ruutu10 eelneva kirjaliku nõusolekuta õigust Veebisaiti ja selle koostisosi mistahes viisil reprodutseerida (kopeerida), levitada, edastada, tõlkida, lülitada teistesse andmebaasidesse, teha väljavõtteid jms viisil kasutada.

6.3. Kasutaja või muu isiku poolt Veebisaidi või selle koosseisu kuuluvate teoste ilma Ruutu10 eelneva nõusolekuta kasutamine või neile viitamine on õigusvastane ja toob endaga kaasa seaduses ettenähtud vastutuse.


Isikuandmete kaitse

7.1. Kasutaja isikuandmete töötlejaks on Ruutu10. Kasutaja isikuandmeid töödeldakse kooskõlas Eesti Vabariigis kehtiva isikuandmete kaitse regulatsiooniga.

7.2. Ruutu10 kogub Kasutaja isikuandmeid Kasutaja Veebisaidile registreerumisel ja muul moel Kasutaja poolt Veebisaidi kasutamisel.

7.3. Töödeldavad isikuandmed on andmed, mida Kasutaja Veebisaidil esitab, kui ta sisestab andmeid Piletite ostmiseks või Veebisaidi kasutajaks registreerimiseks. Sellisteks andmeteks on nt Kasutaja nimi, vanus, e-posti aadress, telefoninumber ja makse teostamiseks vajalikud andmed.

7.4. Ruutu10 kasutab isikuandmeid Kasutajale teenuste osutamiseks. Nimetatud teenuste all tuleb eelkõige silmas pidada Veebisaidil Kasutajatele Piletite ja kauba müügiks, töötubadese registreerimiseks ja uudiskirja saatmist.

7.5. Kasutajal on õigus isikuandmete töötlemiseks antud nõusolek igal ajal tagasi võtta, nõuda isikuandmete töötlemise lõpetamist ja kogutud isikuandmete kustutamist või sulgemist, samuti kasutajakonto sulgemist. Kasutajal on õigus uudiskirja tellimus igal ajal lõpetada kooskõlas Veebisaidil ja Ruutu10 uudiskirjades toodud juhistega. Eelnimetatud isikuandmete töötlemise nõusolekut ei saa tagasi võtta tagasiulatuvalt.

7.6. Ruutu10 ei edasta Kasutaja kohta saadud isikuandmeid kolmandatele isikutele, v.a punktis 7.4 toodud eesmärkidel Ruutu10-ga samasse kontserni kuuluvatele äriühingutele või ettevõtte ülemineku korral kolmandale isikule, mis Ruutu10 omandab.


Lõppsätted

8.1. Kasutustingimused jõustuvad Ruutu10 ja Kasutaja vahel hetkest, kui Kasutaja annab käesolevate Kasutustingimustega nõustumise kohta vastava elektroonilise kinnituse või kui Kasutaja asub Veebisaiti kasutama.

8.2. Kasutustingimusi on Ruutu10-l õigus muuta avaldades vastavasisulise info Veebisaidil. Muudatused jõustuvad Veebisaidil avaldamisest alates.

8.3. Juhul, kui mõni kasutustingimuste säte on kehtetu vastuolu tõttu seadusega, ei mõjuta see ülejäänud Kasutustingimustes toodud sätete kehtivust. Kui mõni Kasutustingimuste säte on tüüptingimusena tühine, on selline säte kehtiv, kui Kasutajaks ei ole tarbija.

8.4. Veebisaidi kasutamisest tulenevatele õigussuhetele Ruutu10 ja Kasutaja vahel kohaldatakse Eesti Vabariigi õigusakte. Poolte vahel käesolevast Lepingust tulenevad vaidlused lahendatakse läbirääkimiste teel. Kui Poolte vahelist vaidlust ei õnnestu lahendada läbirääkimiste teel, lahendatakse vaidlus Eesti Vabariigi seadusandlusega ettenähtud korras, juriidilisest isikust Kasutaja puhul Harju Maakohtus. Tarbijast Kasutaja võib vaidluse korral pöörduda ka Tarbijavaidluste komisjoni poole, mille menetlusreeglitega on võimalik tutvuda ning avaldust esitada siin. Tarbija võib pöörduda Euroopa Liidu tarbijavaidlusi lahendava platvormi poole.
